Picher, Oklahoma: A Ghost Town’s Environmental Legacy

Once, Picher, Oklahoma was a bustling mining town — essential for the U.S. war effort, vital to the economy, and a place where families lived side by side with industry. But today, it stands as a haunting monument to the dangers of unchecked resource extraction. Situated at the heart of the Tar Creek Superfund site, Picher’s history is marked by toxic waste and environmental devastation.

In the early 20th century, the mines produced zinc and lead, materials essential for both World Wars. Yet, the mining methods left behind piles of chat, the toxic waste from the mining process. It scattered across the town. It covered roads. This was a major health hazard, though a silent one. No one knew it was dangerous. In fact, they thought they could put it to use. And so, they filled children’s sandboxes with it. But the evidence started to creep in: lead poisoning, contaminated drinking water, and the slow, insidious collapse of the town itself.

When the mines closed in the 1970s, the damage had already been done. In 1980, the EPA declared the area a Superfund site, a designation that sparked federal cleanup efforts. But despite decades of attempts to remedy the damage, Picher’s fate was sealed: in 2009, it was abandoned, its residents relocated in a government buyout.

Now, the town is a ghostly reminder of what can happen when industrial practices are left unchecked. Its derelict buildings and leftover chat piles stand as a powerful cautionary tale — one that underscores the urgent need for sustainable resource management.  The town not only highlights the need for responsible mining practices but also underscores the importance of remediation and strict environmental regulations to prevent similar tragedies. Picher’s legacy is a stark call to action: Protecting the environment is not just an option — it’s a responsibility.

    Everyone acts as if Picher is the only threat to health and the only over mined area. The aquifers don’t recognize the invisible boundary lines encompassing Picher. The Superfund Site isn’t just the “Tar Creek Superfund Site”…. Picher’s only a small portion of the TRI-STATE MINING DISTRICT (TSMD) SUPERFUND SITE: OK, KS and MO. What about Oronogo -Duenweg, Jasper County, MO? What about Cherokee County, KS?

    “Lead and Zinc” are always noted by the EPA. Sometimes they’re generous enough to mention the Cadmium. What about the Uranium and Thorium and Barium and Cesium? Cobalt, Copper, Boron and Zirconium, etc? Where does the chronic Radium 226 and 228 in our drinking water stem from if not the decay byproducts of our Uranium and Thorium contamination?

    The government used the TSMD as their laboratory beginning in 1940. Especially where they placed their “Concentration Plants”, like Picher and Oronogo and Waco. They had a before-and- after “Industrial Hygiene Survey” to see their “results” (cause and effects to the radiation victims) from intentionally making fine powders of “MVT” ores… (originally named “Joplin Lead” and or “J-Lead”). It wasn’t the former lead and zinc of WWI…in WWII the Manhattan Engineering District AKA Manhattan Project sought the rare uranium 235 and common Uranium 238. Both were processed by Jayhawk Ordinance Works and then Spencer Chemical Co. (Kenneth A. Spencer was in charge of both). Additionally, foreign ores were brought in from Mexico, South America, Canada, New Mexico, etc for processing…by American Zinc Lead and Smelting Co/Government partners. Engineers for the Atomic Energy Commission (AEC), “Fenix and Sisson” had mines in Oronogo and Duenweg. Oronogo mine tunneled underground to Picher. Underground railways flooded frequently. All mines had to be drained simultaneously or they’d refill from the other mines not being pumped dry.

    After 8 years of denials from the Government, Sally Shupack was finally able to get restitution (and medical coverage) for the Spencer employees…or their heirs inherited the restitution for the shortened lives of their loved ones. Sally’s dad died of cancer from radiation exposure at Spencer Chemical. But NO ONE will acknowledge and take responsibility for those living in this TSMD “laboratory” that weren’t working at Spencer Chemical. I’ve tried… and failed.

    All of these heavy metals and radioactive ores are so fine as to be unseen in drinking water, air or soil. During rain events, these nanoparticles rise up from the flooded mine shafts and through the karst rocks and fissures and recontaminate the already remediated yards. The government used “Technical Impracticability” (TI) waivers so as NOT to spend the required funds needed to keep us safe. They kept the health risks a secret. They still haven’t taken responsibility for their actions.

    In 1983-1985, the General Counsel for the DOE, Theodore Garrish, intentionally allowed an unconstitutional amendment to be turned into an Unconstitutional “Federal Tort Claims Act” (FTCA) law… NEVER intending to pay Radiation victims. The Givone Research Group of Human Radiation Test Subjects filed FTCA claims in 2018. We were told our claims had been sent up for approval…but then Ass Sec’y of Energy, Theodore Garrish, took a SECOND job and suddenly became the Acting General Counsel for the DOE after our claims were filed. I see this as a Conflict of Interest and an Abuse of Authority, since our “approved” FTCA claims were arbitrarily denied, instead of being paid… and he was enforcing his Unconstitutional FTCA scam by becoming DOE’s General Counsel, again.

    Now USGS is seeking MVT ores in northern Arkansas, the lower half of Missouri and eastern Kansas by using low flying planes outfitted with Gamma Radiation Detectors and MRI’s. The grid mapping from these detectors should be completed this summer. I object to further MVT mining and processing. When help wasn’t forthcoming in the past… I cannot abide with more death and disabilities in the future.

    The current DOE nominee, Theodore Garrish, should never be allowed a government job, lobbyist position or even free or paid consulting rights. He’s harmed innumerable veterans and civilians seeking help for their exposures… and he sabotaged their/our chances of getting it, intentionally. God forgive him…

(Wm Barr, the Attorney General, wouldn’t allow us to file pro se,( because we filed as a group)… and we couldn’t find an attorney after our FTCA claims were denied. These are the FTCA rules. Unfair to victims.

    The DOE’s FTCA process needs to be rewritten and made constitutionally fair.

    Garrish needs to retire (again) and his current nomination be rescinded. Prosecution, if possible.

    And the DOE needs to honor the initial APPROVAL of our FTCA claims…and pay the RIGHTFUL restitution to the Givone Research Group of Human Radiation Test Subjects… and not contaminate us with future MVT mining and processing. We object. Rev 11:18
